"Thomas Hillary the
immigrant, came to Maryland before 1660. On May
2, 1661, John Bateman "Demandeth 600 acres
for transporting a group of 12, including Thomas
Hilleary." Note: From 1634 until 1641, any
settler who transported himself to Maryland and
brought certain tools and supplies was given 100
acres for himself and 100 more for each adult he
brought to the colony, plus 50 for each child.
From 1641 to 1689 the grant was cut in half, and
after 1689 no more free land was given. Many who
were transported came as indentured servants, and
repaid the cost of their passage by seven years
of service. The employer then owed each his
freedom and 50 acres of land. "Hilleary
must have been able to pay for his own travel; in
1663 he patented 1050 acres, which he called
"Three Sisters;" near the town of
Hyattsville. He also acquired
"Branford" and "The Farme."
"Three Sisters," which became his home
was in present day Washington, D.C.--originally
part of Calvert County.
"Thomas Hilleary Sr, served as Lt.
Colonel in the Calvert County militia (Monnett).
In 1696, he was high sheriff of Prince George's
County (newly formed from Calvert) in 1695.
"Hilleary donated land for All Saints, an
historic old Episcopal church of upper Calvert
County, at present day Sunderland. He died in
1697/98. His will of February 2, 1697/98 proved,
March 15, 1697/98, disposed of a large estate.

Records]. His land was divided among his
children. Young Thomas Jr. was named
executor."

Of the children of Thomas HILLEARY, only Tabitha,
Verlinda, and Thomas can be attributed - in the current
state of research - to the maternal parentage of Eleanor
SPRIGG.
Note 3: According to Effie Gwynn Bowie, Across
the Years in Prince George's County, Tabitha HILLEARY
was sixteen years of age in 1697. But, according
to the Will of Lt. Thomas HILLEARY, Tabitha HILLEARY was
not yet 16 years of age by 2 February 1697. Also see Mullikins

age 18, and his wife, Priscilla. The witnesses to his
Will were Henry AUSTIN, Sr. and Henry AUSTIN, Jr.
William LYLES, the brother of Robert LYLES, Jr.,
signed his Will on 7 February 1733 and his Will was also
proved, in Calvert County, on 22 March 1733. His heirs
were his sons Henry, Robert, and William, his daughters
Elinor, Elizabeth, and Mary, and his wife Barbara. A
witness to his Will was Henry AUSTIN, Jr.
Note 7: Henry AUSTIN, Sr., the second
husband of Elizabeth HILLEARY, was the son of Thomas

Sheviock, Cornwall, England. Henry and brother
Thomas left England in 1685. They were banished
to Barbados after the unsuccessful Monmouth
Rebellion. After two years there they went to
Calvert County, Maryland in 1687 [source: Charles
O. Austin Jr.] Henry AUSTIN, in his will, left
legacies to the LYLE children, Elizabeth's
children from her first marriage.

Maryland: In the name of God Amen. I
Henry AUSTIN of Calvert County in the
province of Maryland, being in good
health of body and of sound and perfect
mind and memory do make and ordain this
my last will and testement in manner and
form following:
First, I desire that my debts be paid
and discharged at the discretion of my
Excors hereafter named and as touching
the Temporal Estate that it hath pleased
God to bestow upon me I do give and
bequeathe in manner and form following:
I do give and bequeathe unto my son
Samuel AUSTIN one half of my estate of
what sort or kind so ever. The other half
I do give and bequeathe unto Henry and
Elinor AUSTIN, son and daughter of Henry
AUSTIN deceased, to be equally divided
between them when they come to full age,
but if one or both of them should die
before they arrive at full age then his
or her parts I do give and bequeathe unto
Henry AUSTIN son of Samuel Austin.
I do give and bequeathe unto my loving
wife Jane AUSTIN one Negro girl called
Janey during the natural life of her the
said Jane AUSTIN, and at her decease I do
give and bequeathe the said Janey unto
Elizabeth the daughter of Samuel AUSTIN.

girl brings I do give and bequeathe unto

After the death of Elizabeth HILLEARY, Henry
AUSTIN married Jane UNKNOWN, the widow of Thomas
HARVEY, Jr. The Will of Thomas HARVEY, Jr. was
signed 17 March 1728/29 and proved 8 May 1729, in
Calvert County, Maryland (Maryland Calendar of
Wills 6:121). The Will mentions son, Thomas
HARVEY, who is to be free at age sixteen and who,
after the death of his mother, is to inherit. The
Will also mentions daughters Elizabeth and Jane
who, if dying without issue, are to have their
portions of the estate assigned to Samuel HARVEY.
The wife of Thomas HARVEY, Jr. is named as
"Mary" (perhaps Mary Jane). The Will
was witnessed by Thomas HARVEY, Robert LYLE
(LYLES), Priscilla LYLE (LYLES) [both the parents
of Robert LYLES, the first husband of Elizabeth
HILLEARY], and Henry AUSTIN.
