  "Thomas Hillary the immigrant, came to Maryland before 1660. On May 2, 1661, John Bateman "Demandeth 600 acres for transporting a group of 12, including Thomas Hilleary." Note: From 1634 until 1641, any settler who transported himself to Maryland and brought certain tools and supplies was given 100 acres for himself and 100 more for each adult he brought to the colony, plus 50 for each child. From 1641 to 1689 the grant was cut in half, and after 1689 no more free land was given. Many who were transported came as indentured servants, and repaid the cost of their passage by seven years of service. The employer then owed each his freedom and 50 acres of land.

"Hilleary must have been able to pay for his own travel; in 1663 he patented 1050 acres, which he called "Three Sisters;" near the town of Hyattsville. He also acquired "Branford" and "The Farme." "Three Sisters," which became his home was in present day Washington, D.C.--originally part of Calvert County.

"Thomas Hilleary Sr, served as Lt. Colonel in the Calvert County militia (Monnett). In 1696, he was high sheriff of Prince George's County (newly formed from Calvert) in 1695.

"Hilleary donated land for All Saints, an historic old Episcopal church of upper Calvert County, at present day Sunderland. He died in 1697/98. His will of February 2, 1697/98 proved, March 15, 1697/98, disposed of a large estate. [Prince George's County. Will Book 7:321, Hall of Records]. His land was divided among his children. Young Thomas Jr. was named executor."

  Will of Thomas HILLERY of Calvert County, Maryland. To wife Ellinor, 250 acres, part of the "Three Sisters." To son John and heirs, 400 acres., part of "Three Sisters." aforesaid. To two grandsons, viz., Baruch and Thomas WILLIAMS, 100 acres. each, part of the "Three Sisters." To two daughters, Mary BERRY and Elisa LYLES, all personal estate formerly belonging to Baruch WILLIAMS. To daughter Frances WILSON, daughters Belinda and Tabitha at 16 years of age, and to son John, personalty. Son Thomas, executor and residuary legatee of personal property. Of the children of Thomas HILLEARY, only Tabitha, Verlinda, and Thomas can be attributed - in the current state of research - to the maternal parentage of Eleanor SPRIGG.

Note 3: According to Effie Gwynn Bowie, Across the Years in Prince George's County, Tabitha HILLEARY was sixteen years of age in 1697. But, according to the Will of Lt. Thomas HILLEARY, Tabitha HILLEARY was not yet 16 years of age by 2 February 1697. Also see Mullikins of Maryland (1932) by Elizabeth Hopkins Baker.

Note 6: Robert LYLES, Sr., the first husband of Elizabeth HILLEARY, was the son of William LYLES (1640, England - 1696, Calvert County, Maryland, British North America) and Priscilla BALL (ABT 1642, England - ABT 1700, Maryland, British North America) who were married 5 January 1662/63 in Calvert County, Maryland.

  Abstract of Will of Robert LYLES, dated 4 June 1705 and proven 9 October 1705 in Calvert County, Maryland:

To wife, Elizabeth, Extx., and heirs, 300 acres "Walton" being part of tract of 500 acres near branch of the Potomac River, and to have use of dwelling plantation during her natural life.

To 2nd son, Robert and heirs, part of land where I now live.

To daughter, Mary and heirs, 50 acres, part of land aforesaid, provided it not be sold by Executrix within 12 months.

To eldest son, William and heirs, residue of land and dwelling plantation.

Testator desires transfer made to Edward BALL of plantation on which said Ball now lives, also 24 acres to be transferred to Michael Askews.

Priscilla NUTHALL, the wife of Robert LYLES, Jr., was the daughter of John NUTHALL VI (ABT 1675, Maryland, British North America - 1714, Maryland, British North America) and Eleanor SPRIGG (BEF 1669 and EST 1668, Northampton Manor, Calvert [later Prince George’s] County, Maryland, British North America - BY 9 February 1727/28, Prince George's County, Maryland, British North America. John NUTHALL VI was the son of John NUTHALL V (ABT 1665, Calvert County, Maryland, British North America - AFT 22 November 1713 [Will signed] and BEF 28 September 1714 [Will proved], St. Mary’s County, Maryland, British North America) and Barbara UNKNOWN (ABT 1649 - ?), ABT 1670, Maryland, British North America. John NUTHALL VI was first married to Mary BRENT (ABT 1675, Stafford County, Virginia, British North America - ABT 1698, St. Mary’s County, Maryland, British North America), 1694, in St. Mary’s County, Maryland. Lucy BOWIE (ABT 1738, Calvert County, Maryland, British North America - ?), ABT 1756, Calvert County, Maryland, British North America.

Robert LYLES, Jr. signed his Will on 28 February 1733 and the Will was proved, in Calvert County, on 22 March 1733. His heirs were his sons, Zachariah and Hilleary at age 18, and his wife, Priscilla. The witnesses to his Will were Henry AUSTIN, Sr. and Henry AUSTIN, Jr.

William LYLES, the brother of Robert LYLES, Jr., signed his Will on 7 February 1733 and his Will was also proved, in Calvert County, on 22 March 1733. His heirs were his sons Henry, Robert, and William, his daughters Elinor, Elizabeth, and Mary, and his wife Barbara. A witness to his Will was Henry AUSTIN, Jr.   

Note 7: Henry AUSTIN, Sr., the second husband of Elizabeth HILLEARY, was the son of Thomas AUSTIN (AUSTEN), Sr. (ABT 1625, Sheviock, Cornwall, England - 1743, England) and Mary LAVERS (23 January 1623/24, St. Germans, Cornwall, England - ?) who were married 28 November 1645, in St. Germans, Cornwall, England. About Henry AUSTIN, the following notes are from Tim Smith <T i m P a u l a S @ M C H S I . c o m>:

  Baptized August 3, 1668, Sheviock, Cornwall, England. Henry and brother Thomas left England in 1685. They were banished to Barbados after the unsuccessful Monmouth Rebellion. After two years there they went to Calvert County, Maryland in 1687 [source: Charles O. Austin Jr.] Henry AUSTIN, in his will, left legacies to the LYLE children, Elizabeth's children from her first marriage.
   
  Last Will and Testament of Henry AUSTIN of Calvert County, Maryland:

In the name of God Amen. I Henry AUSTIN of Calvert County in the province of Maryland, being in good health of body and of sound and perfect mind and memory do make and ordain this my last will and testement in manner and form following:

First, I desire that my debts be paid and discharged at the discretion of my Excors hereafter named and as touching the Temporal Estate that it hath pleased God to bestow upon me I do give and bequeathe in manner and form following:

I do give and bequeathe unto my son Samuel AUSTIN one half of my estate of what sort or kind so ever. The other half I do give and bequeathe unto Henry and Elinor AUSTIN, son and daughter of Henry AUSTIN deceased, to be equally divided between them when they come to full age, but if one or both of them should die before they arrive at full age then his or her parts I do give and bequeathe unto Henry AUSTIN son of Samuel Austin.

I do give and bequeathe unto my loving wife Jane AUSTIN one Negro girl called Janey during the natural life of her the said Jane AUSTIN, and at her decease I do give and bequeathe the said Janey unto Elizabeth the daughter of Samuel AUSTIN. And the first child that the said Negro girl brings I do give and bequeathe unto Mary the daughter of Samuel AUSTIN. I do give and bequeathe unto Elizabeth LYLE, daughter of William LYLE, two young ewes.

And I do hereby constitute, ordain and appoint my loving wife and my son, Samuel AUSTIN, joint executors of this my last will and testament, revoking and disannuling all other will or wills heretofor made, and I desire that my body may be decently buried on the plantation that I now dwell upon between my late wife and daughter.

In witness hereof I have hereunder set my hand and seal this 18th day of January, 1743. (signed) Henry AUSTIN

Signed, sealed and acknowledged in presence of us, William LYLES and Elinor LYLES.

My further will and pleasure is that my grandson Henry Austin son of Henry AUSTIN may have unto his part one Negro boy named Caesar, and that my granddaughter Elinor have one Negro girl named Nancy. (signed) Henry AUSTIN

The above will was proved August 31, 1745.

After the death of Elizabeth HILLEARY, Henry AUSTIN married Jane UNKNOWN, the widow of Thomas HARVEY, Jr. The Will of Thomas HARVEY, Jr. was signed 17 March 1728/29 and proved 8 May 1729, in Calvert County, Maryland (Maryland Calendar of Wills 6:121). The Will mentions son, Thomas HARVEY, who is to be free at age sixteen and who, after the death of his mother, is to inherit. The Will also mentions daughters Elizabeth and Jane who, if dying without issue, are to have their portions of the estate assigned to Samuel HARVEY. The wife of Thomas HARVEY, Jr. is named as "Mary" (perhaps Mary Jane). The Will was witnessed by Thomas HARVEY, Robert LYLE (LYLES), Priscilla LYLE (LYLES) [both the parents of Robert LYLES, the first husband of Elizabeth HILLEARY], and Henry AUSTIN.

By Henry AUSTIN, Sr., Elizabeth HILLEARY engendered Samuel AUSTIN (ABT 1710, Calvert County, Maryland, British North America - 1765, Calvert County, Maryland, British North America) [M]: m. Elizabeth MARSHALL; and Henry AUSTIN (Jr.) (ABT 1712, Calvert County, Maryland, British North America - January 1741, Calvert County, Maryland, British North America) [M]: m. Priscilla PIERCE, 7 October 1736.

Note 8: Benjamin BERRY (Sr.), the husband of Mary HILLEARY, was the son of William BERRY (Jr.) (ABT 1640 - 30 April 1691, Talbot County, Maryland, British North America) and Margaret Naomi MARSH (ABT 1640 - 16 February 1688, Talbot County, Maryland, British North America).

Note 9: Joseph WILSON was the son of James WILSON (ABT 1630, England or Scotland - 1672, Calvert County, Maryland, British North America) and Margaret <KIDD?> who seems identified in the Will of William Kidd, Calvert County, Maryland, signed 20 March 1692 and proved 20 April 1693: "Daughter Margaret WILSON to have wife's share at her decease." Joseph WILSON died intestate. The WILL of Frances HILLEARY, written 17 February 1735, names the following children:

1. Ruth, b. G1712, m. (1) Michael JONES of Maryland; Family moved south and settled in South Carolina. Elder BEALLs died there. After JONES's death, Ruth m. (2) John PHILLIPS of Georgia and had other children; d. Richmond or Warren Co, Georgia. Ruth's JONES children married into HARVEY line of South Carolina, also southern STOVALL line in Mississippi. Note 2: The names of Ruth, Jacob, and Mary BEALL are found in Henry C. Peden, Marylanders to Carolina, Willow Bend Books, 65 East Main Street, Westminster, Maryland, 1999. Peden, however, says that Thomas BEALL and Tabitha HILLEARY migrated, with their children, to South Carolina previous to 1794. He perhaps meant to write 1694; but, if so, that seems much too early.
